SOFTWARE LICENSE AGREEMENT

This is a legal agreement between you and Peter Wiseman/Digital Smoke
covering your use of Solitaire City for Palm OS. Be sure to read the
following agreement before using the Software. BY USING THE SOFTWARE
(REGARDLESS OF WHETHER YOU HAVE REGISTERED THE SOFTWARE OR NOT), YOU ARE
AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE
TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE AND DESTROY ALL
COPIES IN YOUR POSSESSION.
TRIAL VERSION

This is a Trial Version of Solitaire City for Palm OS powered devices
and allows you to play for a total of five hours actual game time while
you decide whether you'd like to buy the software. Based on an average
game duration of three minutes, you should be able to play around 100
times before the game expires. This should be plenty of time for you to
decide whether you'd like to purchase Solitaire City or not. If you'd
like to continue playing once your trial period has ended, you must
purchase a Registration Key over the internet. On the other hand, if you
discover that Solitaire City isn't your type of game then simply delete
it from your Palm handheld device and use the un-installer to remove it
from your Windows hard drive. No harm done and you can download
something else to try instead. However, if you do like my game then
please show your support by purchasing a Registration Key, allowing you
unlimited play and two years of free upgrades. If enough people register
then I will continue to upgrade and improve Solitaire City. Small
independent developers such as myself lack the huge development budgets
that major publishers enjoy and so every registration is greatly
appreciated and goes towards enhancing Solitaire City in the future.
DISTRIBUTION

This license allows you to install the Trial Version of Solitaire City
on as many computers and Palm handheld devices as you like. You are also
encouraged to pass a copy of this Trial Version along to as many friends
as possible for evaluation. If you do so, you must provide them with the
original, unmodified .EXE, .ZIP or .SIT file that you downloaded from
the internet or you may point them in the direction of my website at
http://palm.solitairecity.com where the latest Trial Version will always
be available for download. Attempting to beam the application between
Palm devices may not work. If you'd like to beam Solitaire City to a
friend's Palm handheld then please select "Beam Solitaire City" from
under the application's "Game" menu. This will ensure that all the
necessary databases are transferred.

This Trial version of Solitaire City may be freely distributed as long
as the original files remain intact and unaltered in any way. Additional
files such as readme's, card sets, backgrounds and sound effects may be
added at the distributors discretion, but all the original files must
also be included.
Registration Key

If you have purchased a Registration Key then you MUST NOT give it to
anybody. It is your own personal license to use Solitaire City beyond
the trial period and distribution of your key would be a serious breach
of copyright laws.
Vendors

Magazine Cover Disc Vendors and Shareware Distributors may charge a
nominal fee for distribution of this Trial Version of Solitaire City
which must not exceed the reasonable cost of duplication and materials.
This Trial Version must not be sold for profit ! The recipient of
Solitaire City must be informed, in advance, that this version is a
Trial Version that expires and that the fee paid to acquire this Trial
Version does not entitle them to the Registered Version of Solitaire
City which they must purchase separately. Please contact Peter Wiseman

propositions not covered here.
COPYRIGHT

Solitaire City is owned by Peter Wiseman/Digital Smoke and is protected
by copyright laws and international treaty provisions. You must treat
this software like any other copyrighted material (e.g. a book or
musical recording). You may not rent, lease modify, translate,
disassemble, de-compile, reverse engineer or create derivative works
based upon this software or use the graphics for your own purposes.
LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

This software and accompanying written materials (including instructions
for use) are provided "AS IS" without warranty of any kind. Further, the
author does not warrant, guarantee, or make any representations
regarding the use, or the results of use, of the software or written
materials in terms of correctness, accuracy, reliability, current-ness,
or otherwise. The entire risk as to the results and performance of the
software is assumed by you. If the software or written materials are
defective, you, and not the author or his dealers, distributors, agents,
or employees, assume the entire cost of all necessary servicing, repair,
or correction.

The above is the only warranty of any kind, either express or implied,
including but not limited to the implied warranties of merchantability
and fitness for a particular purpose, that is made by the author of this
product. No oral or written information or advice given by the author,
his dealers, distributors, agents or employees shall create a warranty
or in any way increase the scope of this warranty and you may not rely
on any such information or advice. You may have other rights which vary
from state to state.

Neither the author nor anyone else who has been involved in the
creation, production or delivery of this product shall be liable for any
direct, indirect, consequential or incidental damages (including damages
for loss of business profits, business interruption, loss of business
information, and the like) arising out of the use or inability to use
such product even if the author has been advised of the possibility of
such damages.

This Agreement shall be governed by the laws of the State of Nevada. If
for any reason a court of competent jurisdiction finds any provision of
the Agreement, or portion thereof, to be unenforceable, that provision
of the Agreement shall be enforced to the maximum extent permissible so
as to effect the intent of the parties, and the remainder of this
Agreement shall continue in full force and effect.
ACKNOWLEDGMENT

By installing this version of Solitaire City, you acknowledge that you
have read the above license agreement, understand it, and agree to be
bound by its' terms and conditions. You also agree that the license is
the complete and exclusive statement of agreement between the parties
and supersede all proposals or prior agreements, oral or written, and
any other communications between the parties relating to the subject
matter of the limited warranty.
